       2018年7月2日,德和衡华盛顿律师事务所参加了乔治城大学法学院关于美国最高法院Carpenter v. United States案件对美国宪法第四修正案的影响的论坛。该案件提高了对隐私保护权认定的标准,将相关性标准提高到有犯罪可能性。

Washington, DC, Georgetown Law Center – On July 2, 2018, the DHH Washington D.C. Law Office attended a lecture on the implications of the recent Supreme Court 5-4 decision Carpenter v. United States, which overturned precedent on Fourth Amendment privacy rights. The case involved prosecutors’ use of cell phone location data obtained from third party providers (cell phone companies) under the 1986 Stored Communications Act. The Act only requires the information be relevant and material to the investigation instead of the normal Fourth Amendment probable cause standard. In Carpenter, the Supreme Court decided that the ubiquitous use of cell phones required investigators seek a warrant, applying the probable cause standard, when collecting seven or more days of location data.

Explaining the opposite perspectives, the speakers discussed how the Carpenter ruling may be applied narrowly or broadly in different jurisdictions and how this will affect police work and criminal trials. Overall, though, it was agreed that the police still have many tools to accomplish similar case building goals, but this ruling may be a watershed case for future changes in privacy rights in the digital age.
