As a core component of project management, personnel management has become increasingly prominent. International engineering projects involve participants across national and cultural boundaries, with diverse personnel composition and complex management scenarios. Coupled with differences in national laws, regulations and industrial codes, personnel management is confronted with numerous challenges.The FIDIC Conditions of Contract (2017 Edition), as a universal standard contract template in the field of international engineering, provides more detailed and explicit provisions on personnel management, further specifying the performance requirements of personnel of all parties. It offers an important basis for resolving disputes over personnel management and avoiding management risks in international engineering projects.Against this background, a systematic study on the core content of personnel management in international engineering projects based on the 2017 FIDIC Conditions of Contract carries significant practical value.
This study takes the 2017 FIDIC Conditions of Contract, encompassing the Conditions of Contract for Construction and the Conditions of Contract for EPC/Turnkey Projects, as its primary analytical framework. Centering on the core challenges of personnel management in international engineering projects, it integrates empirical insights from professional practice. The research meticulously clarifies the composition and functional roles of project personnel, systematizes the operational essentials of key position management, identifies critical management dilemmas and nuanced challenges. Furthermore, it conducts an in-depth analysis of potential risk categories and proactive mitigation strategies, and synthesizes valuable precedential experience in dispute resolution. 1. 业主代表

由业主指定并书面通知承包商和工程师,作为业主的全权代表,行使合同约定的业主权利,履行业主义务,包括但不限于批准工程师的重要指令、确认项目重大变更、支付工程款项、协调业主内部及与外部相关方(如当地政府、社区)的关系。2017版FIDIC明确要求业主代表的任命需书面告知,且其行为对业主具有约束力,若更换业主代表需提前通知相关方并说明理由。
The Employer’s Representative is appointed by the Employer and notified in writing to the Contractor and the Engineer, acting as the full‑authority representative of the Employer. The Chief Engineer shall be appointed by the Consulting Party (Engineer) as its fully authorized representative, who shall be responsible for overall planning and coordination of all technical and managerial affairs of the Consulting Party (Engineer). 工程师应严格遵循 2017 版 FIDIC 合同条件确立的独立判断原则,在执业过程中保持中立,不偏袒业主或承包商任何一方,始终以专业知识、行业规范与合同约定为依据作出客观决策,保证决策的公正性与专业性。同时,工程师应具备丰富的国际工程设计与监理经验,熟悉项目所在国技术标准与行业规范,具备独立处理复杂技术问题的能力。
The Engineer shall strictly abide by the principle of independent judgment established under the 2017 Edition FIDIC Conditions of Contract, maintain neutrality in practice without favoring either the Employer or the Contractor, and make objective decisions based on professional knowledge, industrial standards and contractual stipulations at all times, so as to ensure the fairness and professionalism of decisions. Meanwhile, the Engineer shall possess extensive experience in international engineering design and supervision, be familiar with the technical standards and industrial norms of the host country, and be capable of independently resolving complex technical issues.
2. 指令管理
Instruction Management
工程师签发的工程指令、变更指令、支付证书等均应采用书面形式,明确指令内容、执行要求与完成期限,并建立完整的记录与归档制度,确保指令全程可追溯。指令签发必须符合合同约定的权限范围,严禁擅自签发越权指令;对涉及重大变更的指令,应充分征求业主与承包商双方意见,履行相应程序后再正式出具。
All engineering instructions, variation orders, payment certificates and other documents issued by the Engineer shall be in written form, specifying the content, implementation requirements and completion deadlines. A complete recording and filing system shall be established to ensure full traceability of all instructions. Instructions must be issued within the scope of authority stipulated in the Contract; ultra vires instructions are strictly prohibited. For instructions involving material variations, the views of both the Employer and the Contractor shall be fully solicited, and relevant procedures shall be completed before formal issuance.
3. 现场监督
On-site Supervision
工程师应统筹监理团队开展全过程现场监督,定期对施工现场进行巡查,重点检查施工质量、进度、安全、环保等措施的落实情况。对现场发现的问题,应及时督促承包商限期整改,并留存完整的监督、检查及整改记录,为工程验收、中期支付与最终结算提供真实、有效的依据。
The Engineer shall coordinate the supervision team to carry out full-process on-site supervision and conduct regular inspections of the construction site, focusing on the implementation of construction quality, progress, safety, environmental protection and other measures. Any on-site defects shall be promptly referred to the Contractor for rectification within a specified time limit, with complete records of supervision, inspection and rectification retained, so as to provide authentic and valid evidence for project acceptance, interim payments and final settlement.
4. 争议调解
Dispute Mediation
依据 2017 版 FIDIC 合同条件相关规定,工程师承担业主与承包商之间轻微争议的调解职责。在争议处理过程中,应坚持公平、公正、合理原则,充分听取双方陈述与理由,在查清事实的基础上提出专业、可行的调解方案,引导双方协商解决分歧,防止争议扩大化或升级为正式纠纷。
Pursuant to the relevant provisions of the 2017 Edition FIDIC Conditions of Contract, the Engineer shall be responsible for mediating minor disputes between the Employer and the Contractor. In dispute settlement, the Engineer shall adhere to the principles of fairness, impartiality and reasonableness, fully consider the statements and grounds of both parties, and put forward professional and feasible mediation proposals on the basis of ascertaining facts, so as to guide the parties to resolve differences through consultation and prevent disputes from expanding or escalating into formal conflicts.
(三)承包商代表管理要点
Management Points for the Contractor’s Representative
1. 资格审核与批准
Qualification Review and Approval
按照 2017 版 FIDIC 合同条件相关约定,承包商代表的任命必须经工程师和业主共同批准。承包商需向双方提交承包商代表的完整资质证明,包括但不限于专业资格证书、国际工程项目管理经验证明等,确保其具备胜任岗位所需的管理能力与专业水平。若因特殊情况需更换承包商代表,需提前书面通知工程师和业主,同步提交替代人员的资质证明文件,经双方审核批准后,方可完成人员更换,严禁擅自更换承包商代表。
In accordance with the relevant stipulations of the 2017 Edition FIDIC Conditions of Contract, the appointment of the Contractor’s Representative must be approved jointly by the Engineer and the Employer. The Contractor shall submit complete qualification documents of the Contractor’s Representative to both parties, including but not limited to professional certificates and evidence of international engineering project management experience, so as to ensure that the appointee possesses the managerial and professional competence required for the position. If the Contractor’s Representative needs to be replaced due to special circumstances, the Engineer and the Employer shall be notified in writing in advance, and qualification documents of the replacement shall be submitted simultaneously. The replacement may only be completed after review and approval by both parties; unauthorized replacement is strictly prohibited.
2. 合同履行
Contract Performance
承包商代表需全面履行 2017 版 FIDIC 合同条件及项目合同约定的承包商义务,统筹负责施工现场的各项管理工作。需结合项目实际制定科学合理的施工计划与施工方案,有序组织施工队伍开展作业,严格把控项目质量、进度、安全及成本管控,确保各项指标符合合同约定标准。同时,需及时响应工程师签发的各类指令,主动配合工程师开展现场监督、检查工作,按时提交进度报告、工程量清单等相关资料,保障项目施工有序推进。
The Contractor’s Representative shall fully perform the Contractor’s obligations stipulated in the 2017 Edition FIDIC Conditions of Contract and the project agreement, and be responsible for the overall on-site construction management. Scientific and reasonable construction plans and schemes shall be formulated based on actual project conditions to organize the construction team in orderly operations, with strict control over project quality, progress, safety and cost, so as to ensure that all indicators meet contractual standards. Meanwhile, the Contractor’s Representative shall respond promptly to all instructions issued by the Engineer, take the initiative to cooperate with the Engineer in on-site supervision and inspection, and submit progress reports, bills of quantities and other relevant materials on schedule, so as to ensure orderly construction.
3. 团队管理
Team Management
承包商代表需加强对承包商内部管理团队、技术团队及施工队伍的统筹管理,明确各岗位的职责分工,建立科学有效的考核激励机制,不断提升团队的凝聚力与执行力。同时,需严格遵循 2017 版 FIDIC 合同条件要求,对所有施工人员的资质、技能进行严格审核,确保施工人员具备岗位所需的资质与能力;定期组织施工人员开展专业技能、安全规范等相关培训,加强日常管理,规范施工人员的作业行为,保障施工过程合规有序。
The Contractor’s Representative shall strengthen the overall management of the Contractor’s internal management team, technical team and construction team, clarify the division of responsibilities for each position, establish a scientific and effective assessment and incentive mechanism, and continuously enhance team cohesion and execution. Meanwhile, in strict compliance with the 2017 Edition FIDIC Conditions of Contract, the qualifications and skills of all construction personnel shall be rigorously reviewed to ensure they possess the required qualifications and competence. Regular training on professional skills and safety regulations shall be organized to strengthen daily management, standardize construction operations, and ensure compliant and orderly construction.
4. 沟通对接
Communication and Liaison
承包商代表需建立常态化、规范化的沟通对接机制,定期与业主代表、总工程师对接项目施工进展情况,主动反馈施工过程中出现的各类问题,包括但不限于场地交付问题、设计优化问题、物资供应问题等,积极主动协调各方资源解决问题,确保项目顺利推进。同时,需加强与分包商的沟通对接,严格监督分包商履行分包合同约定,督促分包商把控分包工程的质量与进度,确保分包工程与整体工程衔接顺畅、同步推进。
The Contractor’s Representative shall establish a regular and standardized communication and liaison mechanism, conduct regular meetings with the Employer’s Representative and the Chief Engineer on construction progress, and proactively report various issues arising during construction, including but not limited to site handover, design optimization, and material supply, and actively coordinate resources among all parties to resolve problems and ensure smooth project progress. Meanwhile, the Contractor’s Representative shall strengthen communication with Subcontractors, strictly supervise their performance of subcontract agreements, and urge them to control the quality and progress of subcontract works, so as to ensure smooth and synchronized interface between subcontract works and the overall project.
